Impactful changes to Law no. 18/1991

Land owners in areas that were not cooperative during the communist period can request the issuance of the title to the county land commissions

According to the new amendments to Law no. 18/1991 regarding the land fund, land owners in areas that were not cooperative during the communist period can request the issuance of the title to the county land fund commissions. This includes especially the owners or their heirs who have not registered in the agricultural production cooperative, have not surrendered or have not had their lands taken over by the state through transferable ownership documents.

According to the legal provisions, these owners or heirs have the right to request the county commission to issue the property title. This right can be exercised if the owners or their heirs appear with the land in the agricultural registers or cadastral registers and in the tax records.

Also, for the land in question to be eligible for the issuance of the property title, it must meet the following conditions:

1. For the respective land, no Land Registry was opened based on the Land Registry and Real Estate Advertising Law no. 7/1996, republished, with subsequent amendments and additions. 2. The land is not the subject of requests for reconstitution or establishment of the right of ownership by other persons. 3. No property title was previously issued regarding it. Thus, if the land owners in the non-cooperative areas meet all these conditions, they have the legal right to request the county land commissions to issue the property title for that land.
