In the Official Gazette with no. 304/2022, Law no. 70/2022 on the regulation of the status of personnel who, during the alert state or of the situations of epidemiological and biological risk, determined by the COVID-19 pandemic, were assigned for a determined period, as well as for the modification and completion of some normative acts.
By derogation from the provisions of art. 30 para. (2) of Law no. 53/2003 – Labor Code, local public administration authorities and ministries and institutions with their own health network, as well as public social assistance institutions organize an examination, in order to fill permanent positions, for staff who, during the alert or situations epidemiological and biological risk, he held non-competitive positions for a fixed period.
The examination is organized before the termination of the individual employment contract / employment relationship and does not apply to staff who have held management positions.
These provisions also benefit the doctors employed in the newly created structures during the alert state, in order to treat COVID-19 patients and for the contract staff within the county public health directorates, respectively the Bucharest municipality and the county ambulance services and the Service. of Ambulance Bucharest – Ilfov, which, during the state of alert, occupied positions for a determined period within the 2000 positions approved for these institutions based on the Government Decision no. 144/2010 on the organization and functioning of the Ministry of Health
